Collaborative Whiteboard Terms of Use

1. Service Description and Acceptance of Terms
OnlineWhiteboard.org ("we," "us," "our," or "the Company") provides a free, no-signup collaborative whiteboard feature ("Service"). The Service allows users to create temporary online rooms and share links for real-time collaboration. All rooms and their contents are automatically and permanently deleted after a limited period of time. No data is guaranteed to be retained beyond this period.
Your access to and use of the Service is conditioned entirely upon your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who access or use the Service. By accessing the Service, you represent that you are at least 13 years of age and have the legal capacity to enter into a binding agreement.
2. "As-Is" Service — No Warranties of Any Kind
THE SERVICE IS PROVIDED STRICTLY ON AN "AS-IS" AND "AS-AVAILABLE" BASIS, WITHOUT ANY REPRESENTATIONS OR WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, WE EXPRESSLY DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:
- Any implied warranty of merchantability, fitness for a particular purpose, title, or non-infringement;
- Any warranty that the Service will be uninterrupted, error-free, secure, or free of viruses or other harmful components;
- Any warranty regarding the accuracy, reliability, completeness, or timeliness of any content or data;
- Any warranty that the Service will meet your requirements or expectations;
- Any warranty arising from course of dealing, course of performance, or usage of trade.
We do not warrant that any content created or shared within rooms will be preserved, transmitted accurately, or remain accessible at any time. You use the Service entirely at your own risk.
3. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL ONLINEWHITEBOARD.ORG, ITS OWNERS, OPERATORS, EMPLOYEES, AGENTS, AFFILIATES, LICENSORS, OR SERVICE PROVIDERS BE LIABLE FOR ANY:
- Direct, indirect, incidental, special, consequential, exemplary, or punitive damages;
- Loss of profits, revenue, data, business, goodwill, or anticipated savings;
- Loss of or damage to content, drawings, messages, or any other information;
- Damages arising from unauthorized access to or use of your session by third parties;
- Damages arising from the actions or content of any other user of the Service;
- Damages arising from service interruptions, downtime, bugs, or technical failures;
- Any other damages, whether based in contract, tort (including negligence), strict liability, or any other legal theory;
EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, AND EVEN IF A REMEDY FAILS OF ITS ESSENTIAL PURPOSE.
IF, NOTWITHSTANDING THE FOREGOING, WE ARE FOUND LIABLE FOR ANY CLAIM ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, OUR TOTAL CUMULATIVE LIABILITY SHALL NOT EXCEED ZERO US DOLLARS (USD $0.00), REFLECTING THE FACT THAT THE SERVICE IS PROVIDED FREE OF CHARGE.
4. User Responsibility and Indemnification
You are solely and exclusively responsible for:
- All content you create, upload, share, or transmit through the Service;
- All actions taken by anyone who accesses the Service using a link you shared;
- Ensuring that your use of the Service complies with all applicable local, national, and international laws and regulations;
- Any consequences, legal or otherwise, resulting from your use or misuse of the Service;
- Exporting, backing up, or otherwise preserving any content before the session expires.
Indemnification: You agree to defend, indemnify, and hold harmless OnlineWhiteboard.org and its owners, operators, employees, agents, and affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from: (a) your use of the Service; (b) content you create or share; (c) your violation of these Terms; (d) your violation of any third-party rights; or (e) any harm caused to any third party as a result of your use of the Service.
5. Acceptable Use Policy
You agree to use the Service only for lawful purposes. You must not use the Service to create, share, transmit, or store any content or engage in any activity that:
- Is illegal, harmful, threatening, abusive, harassing, defamatory, or fraudulent;
- Infringes any patent, trademark, trade secret, copyright, or other intellectual property rights;
- Violates the privacy or personal rights of any person;
- Contains unsolicited commercial communications (spam);
- Attempts to gain unauthorized access to any part of the Service or any third-party systems;
- Overloads, disrupts, or degrades the performance of the Service;
- Involves the transmission of malware, viruses, or other destructive code;
- Is intended to deceive, mislead, or defraud other users or third parties.
We reserve the right to deny or terminate access to the Service for any user who we reasonably believe is in violation of these terms, without notice or liability.
6. Content — No Storage, No Liability
The Service is designed so that no content is ever stored on our servers. All drawings, text, and data exist only within your browser and the browsers of collaborators during the active session. We have no ability to access, monitor, retrieve, or be held responsible for any content created or shared within any room at any time.
Upon session expiration, all content is permanently and irrecoverably deleted. We accept no responsibility for any loss of content. Users are solely responsible for exporting important work as PNG, PDF, or project files before the session ends.
7. Third-Party Users and Shared Links
When you share a room link with other individuals, you assume full responsibility for their access and all actions they take within the room. We have no control over, and accept no liability for, the actions of any third-party users who join via a shared link. You should never share room links publicly or include sensitive, confidential, or personal information in any room session.
8. Session Management and Technical Safeguards
- Rooms expire automatically and permanently after a limited period of time;
- Room links are randomly generated and are not publicly indexed;
- Rate limiting is applied to prevent abuse from any single IP address;
- CAPTCHA or validation challenges may be triggered by suspicious activity;
- We reserve the right to modify, suspend, or terminate the Service at any time without notice.
These safeguards are provided as a courtesy only and do not create any warranty, duty of care, or ongoing obligation on our part.
9. Privacy
No personal information, messages, or drawings are stored by us. However, standard server logs (such as IP addresses and access timestamps) may be retained for security and abuse-prevention purposes as described in our Privacy Policy. By using the Service, you consent to such logging.
10. Intellectual Property
You retain any rights you may have in the content you create within the Service. By using the Service, you grant no license to us in your content, as we neither store nor process it. You represent and warrant that you have all rights necessary to create and share any content you introduce into the Service and that doing so does not infringe any third-party rights.
11. Minors
The Service is not directed at children under the age of 13. By using the Service, you represent that you are at least 13 years old. If you are aware of a minor using the Service, please do not provide them with a room link. We are not responsible for any access to the Service by minors.
12. Modifications to the Service and Terms
We reserve the right to modify, suspend, or discontinue the Service (or any part thereof) at any time, with or without notice, and without any liability to you. We also reserve the right to update these Terms at any time. Changes become effective upon posting to this page. Your continued use of the Service after changes are posted constitutes your acceptance of the revised Terms. It is your responsibility to review these Terms periodically.
13. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with applicable law. Any dispute arising out of or in connection with these Terms or the use of the Service shall be subject to the exclusive jurisdiction of the competent courts in the jurisdiction where the Company operates. YOU WAIVE ANY RIGHT TO A JURY TRIAL IN CONNECTION WITH ANY ACTION ARISING UNDER THESE TERMS TO THE FULLEST EXTENT PERMITTED BY LAW.
To the extent permitted by applicable law, any claim arising out of or related to the Service must be brought within one (1) year of the event giving rise to the claim, after which it is permanently barred.
14. Severability and Waiver
If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. Our failure to enforce any right or provision of these Terms shall not be deemed a waiver of such right or provision.
15. Entire Agreement
These Terms, together with our Privacy Policy and General Terms of Service, constitute the entire agreement between you and OnlineWhiteboard.org with respect to the Service and supersede all prior agreements, representations, and understandings.
16. User Acknowledgement
BY CLICKING "START COLLABORATION," ENTERING A ROOM, OR OTHERWISE USING THE SERVICE, YOU EXPRESSLY ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THESE TERMS IN THEIR ENTIRETY, INCLUDING THE DISCLAIMER OF WARRANTIES, LIMITATION OF LIABILITY, AND INDEMNIFICATION PROVISIONS. IF YOU DO NOT AGREE, YOU MUST NOT USE THE SERVICE.
